Domestic abuse

The government defines domestic abuse as follows:

"any incident or pattern of incidents of controlling, coercive, threatening behaviour, violence or abuse between those aged 16 or over who are, or have been, intimate partners or family members regardless of gender or sexuality."

Furthermore, such abuse may take several forms, including, but not limited to, the following:

  • Psychological
  • Physical
  • Sexual
  • Financial
  • Emotional

Even if children are not the direct target of abuse, they can be affected indirectly by abuse of those close to them and the consequences can be profound. Fortunately, there is the possibility of relief; children can be protected through the use of injunction orders.

Court injunctions

Depending on your wishes and the nature of your case, your solicitor for domestic abuse can help you in several ways.

There are two main types of court injunction available. These are non-molestation orders and occupation orders. Non-molestation orders forbid violent or threatening behaviour, as well as a variety of associated behaviours. Occupation orders lay out certain rules and may prevent a person from occupying or visiting a particular address or property.

All types of court order are treated with sensitivity and confidence by the court and various measures may be enacted to protect the identity of any vulnerable parties involved.

In some cases it may be deemed necessary to make an application to the court at the soonest opportunity – fast-tracked cases are called "without notice applications".
