Court of Protection Panel Deputy re-appointment

I have been re-appointed by the Court of Protection and Office of the Public Guardian as one of only 68 panel deputies in England and Wales.

A Deputy is someone the Court of Protection appoints to manage the financial affairs or welfare of a person who lacks capacity to look after themselves, and does not have an effective power of attorney. Usually a relative would be the best person to be appointed, but in today’s world, families have moved further apart, and have more demanding work and family commitments. They often cannot look after vulnerable people who lack capacity to take decisions for themselves, be it through old age, mental illness or incapacitating accidents. In this case the Court of Protection appoints a professional Deputy who will work alongside or instead of the family, so ensuring that the best interests of the vulnerable individual will come first.

Change the rules

The balance of power is currently with the lenders, which are seeking to control the property market, but how many banks can we or our clients really embargo?

HSBC is not the first - and will by no means be the last - to cull its panels, but it is playing by the rules. However, it seems to me that there is a simple solution for the legal profession to ensure that the balance of power is shifted back towards us - change the rules that we as a profession have put in place so that lenders and borrowers must now seek separate representation. At least that way that will create a market whereby borrowers must seek their own, hopefully local, representation.

Retired Judge admits forging a Will of a Family Member Sunil Kambli Solicitor, Chartered Accountant, CTA, TEP, Notary Public, Panel Deputy & Founding Partner at Premier Solicitors

Nottingham Crown Court recently heard a fraud case against Mrs Margaret Hampshire, (a former Wills & Probate Solicitor, and a retired Judge) and her Husband, Mr Alan Hampshire.

Mr Martin Blanche passed away in 2007, leaving behind a cottage in Rolleston and a 50% share in an adjoining empty cottage, which was co-owned by his cousin, Mrs Josephine Burroughs.

 Mrs Hampshire had a Power of Attorney over Mrs Burroughs’ affairs and took over the Administration of Mr Blanche’s Estate. When clearing out his cottage, Mr and Mrs Hampshire claimed to have found a Will leaving his whole Estate to Mrs Burroughs, including his cottage and interest in the adjoining cottage. The Will was then admitted to Probate by Mrs Hampshire. The properties were then gifted to Mrs Hampshire’s Daughter and renovated using Mrs Burroughs money.

Following a boundary dispute, the matter was investigated by the Police and concerns were raised by neighbours and friends of Mr Blanche regarding the Will and his difficulty to read and write.

A handwriting expert was instructed and concluded that the Will had been forged by Mr Hampshire.

At the beginning of the trial, Mr and Mrs Hampshire pleaded not guilty to all counts. However, during the trial they changed their pleas to guilty and admitted a total of 6 charges, including 3 counts of forgery, 1 count of fraud and 2 counts of theft between them. Other charges were ordered to remain on file.

 Mr and Mrs Hampshire both received three concurrent jail terms of six months with a confiscatory hearing due shortly to decide what is to happen to the renovated property.

Lawyers in Bedfordshire are being urged to raise money for charity by writing wills as part of a national month-long drive.

Legal firms across the county are being asked to sign up to Will Aid Month, which takes place across the country from 01-30 November 2016.

     The programme relies on solicitors to pledge their time and support for the cause which sees them provide the will writing service for free in return for a voluntary donation to charity from their client. The cash raised is split between nine of the UK’s best-loved charities.

Peter de Vena Franks, campaign manager for Will Aid said: “Will Aid 2015 was a fantastic success but we are really hoping 2016 will surpass that. “We want this year to be bigger and better than ever before. Here in Bedfordshire we’re looking for more solicitors to sign up to and donate their time, so we can help more and more people get their finances in order. Having a will is one of the most important, yet easiest things to tick off the to-do list and our charities benefit as a result!” Last year Will Aid raised more than £1million for charity.

In Bedfordshire, 2 solicitors firms signed up to the programme and between them raised £9,000.
