Jack is a Partner and heads the Employment team at Pannone Corporate LLP.

Jack advises on all aspects of employment law. He acts for a range of company clients, including multi-national corporations and public sector organisations, regularly representing them in the Tribunal, County Court and High Court.

He has acted for a number of professional footballers, advising them on their contractual terms and on their exit from clubs.

Jack has a particular interest in TUPE and issues relating to restraint of trade and the enforceability of restrictive covenants (including injunctive proceedings where appropriate).

On the non-contentious side, Jack is well versed in the review of employment contracts and other employment related documentation.

He regularly presents seminars and writes articles on employment law issues. Jack has also provided a number of interviews to TV and other media outlets on employment law issues, including an appearance on BBC Breakfast to discuss issues relating to zero hours contracts.

Praised by his clients for his commercial advice and ability to provide incisive tactical advice, Jack is recognised as a Leader in his Field in the Chambers UK Guide which in 2013 stated, "The 'absolutely superb' Jack Harrington is a rising star within the team, known for his 'extremely proactive' approach” and in 2014 confirmed that "Clients appreciate Jack Harrington's ability to ‘find the solution.’ He regularly works with well-known corporate entities and is noted for his expertise in TUPE matters.”

Experience

Jack advises on all aspects of employment law and current cases include claims relating to unfair dismissal, disability discrimination, age discrimination, race discrimination, TUPE, breach of contract and whistleblowing.  Jack also advises on contractual issues including disputes over bonus entitlement and share options.

Past experience includes:

  • Advising a professional footballer seeking to terminate his contract with a championship club. This required advising on the proposed terms of the agreement with the club under intense time pressure in order to effect the termination before the transfer deadline.
  • Acting on behalf of a Chief Executive of a large public sector organisation who wanted to ensure that his position was protected during an external independent investigation into serous allegations involving the organisation.
  • Acting for a US-owned business communication and information management company, to defend employment tribunal proceedings brought by an ex-employee for constructive unfair dismissal, sex discrimination, sexual harassment, victimisation, race harassment, and disability discrimination.
  • Acting on behalf of a multinational oil company in its defence of a claim of race, religious and disability discrimination and successfully applying to strike out the claim before it went to a full hearing.
  • Acting for a Manchester quasi-public sector organisation in relation to a complex grievance raised by a member of the senior management team during a redundancy consultation. The matter was complicated due to the seniority of the employee, the extent of the grievance which included allegations of unfairness, age and disability discrimination spanning many years, and the adverse impact which the process was having on the business.  Further, the matter was particularly delicate given it involved many members of the senior management team. Jack liaised with the Board and advised on their duties as directors of a quasi-public, not for profit organisation.
  • He successfully represented a Manchester construction company to defend an ET claim for unfair dismissal and whistleblowing. Careful consideration was given to the appropriate tactical approach to the case which helped to narrow the issues and proved useful in keeping the claimant “on track” during the proceedings.
  • Jack has represented clients in the Employment Tribunal, Employment Appeal Tribunal and the Court of Appeal. Reported cases include:
    • Riley V FCHO 2008 UKEAT/0051/08
    • First Choice Homes Limited v Capon & Anor UKEAT 49/11/RN

Case Studies

Strike out of discrimination claim

Acting for a client in its defence of a claim of race, religious and disability discrimination. The claim was originally against both the company and its in house lawyer. The claim against the individual has been struck out but the claims against the company continue. We successfully strike out the remaining claim on a complex jurisdiction point namely that the claimant was a potential agency worker and as she was not actually employed by the agency at the time of her interview with the client she is not covered by the Equality Act as an “employee” and she does not fall within the definition of a “Contract worker”.

Industrial Action

Acting for a public sector employer on a dispute with one of its Trade Unions regarding proposed industrial action relating to changes in terms and conditions of service. I was able to point out the legal defects in the Trade Union’s argument regarding the enforceability of recognition agreements to enable the client to buy time and avoid industrial action.
