Acting for a client in its defence of a claim of race, religious and disability discrimination. The claim was originally against both the company and its in house lawyer. The claim against the individual has been struck out but the claims against the company continue. We successfully strike out the remaining claim on a complex jurisdiction point namely that the claimant was a potential agency worker and as she was not actually employed by the agency at the time of her interview with the client she is not covered by the Equality Act as an “employee” and she does not fall within the definition of a “Contract worker”.
Acting for a public sector employer on a dispute with one of its Trade Unions regarding proposed industrial action relating to changes in terms and conditions of service. I was able to point out the legal defects in the Trade Union’s argument regarding the enforceability of recognition agreements to enable the client to buy time and avoid industrial action.
