Personal

During my time with Berg we completed the three peaks challenge for charity, it was a tough test but the feeling at the top of the last mountain, Snowdon, was incredible. Represented Riding Club to national level on teams in all disciplines of equestrianism, qualified to compete at Olympia International Horse Show in 2013. Riding brings great pressure as the other members of the team are relying not only on you but your horse as well, by keeping calm you can get the most out of your horse and the best result for the team. During university I skied for Bristol Ski Club, we had tremendous success as a direct result of the fantastic team moral. I also have a passion for sailing, although I do not compete, I enjoy the satisfaction you get from negotiating a difficult passage with the rest of the crew.

Refinance

In August 2015, we received instructions from a client who had approximately £6.6m outstanding under a 5 year facility agreement with a major bank.

The bank had advised the client at the time of entering into the facility agreement that the client must purchase a hedging product in order for the facility agreement to be approved.

The client had agreed an exit deal with the bank whereby the client would pay £5.3m to the Bank in full and final settlement of the amounts due. The consideration was being accepted by the bank on the basis that the agreement was also in full and final settlement of all liabilities the bank had to the client save that the client could take part in the IRHP Review and could bring a claim for consequential losses.

The client’s instructions were to review the Settlement Deed that was provided by the bank’s solicitors and advise the client as to the nature and effect of the terms.

However, the matter was also referred to our non-contentious banking team who were able to deal with a refinance for the client.

Due to the time constrains of the settlement with RBS, we arranged a two stage refinance with a bridge between the bank and the clients new lender. The bridge was completed within 2 weeks and the new facility is due to complete imminently. The refinance posed unique difficulties as the residential portfolio is predominantly let to high net worth individuals and as such the letting documents contain confidentiality clauses meaning they could not be disclosed. We worked with the client to provide the comfort to satisfy both the bridging provider and new lender.
